Wine Giveaway Rules, Regulations, and Disclaimer

Giveaway Name: WIN A BOTTLE OF FREY ORGANIC WINE
Giveaway Dates: Beginning SEPTEMBER 19, 2009, 12:01 AM PST and ending SEPTEMBER 30, 2009, 11:59 PM PST.

Raw Epicurean, and its affiliated companies (“Company”), will conduct the Giveaway substantially as described in these rules, and by participating, each participant agrees as follows:

*Giveaway Eligibility
At the end of the giveaway, the gift will be awarded to three randomly chosen winners from all entries received within 48 hours from the giveaway deadline. Winner(s) may be notified by e-mail. Deadline for registration is 11:59 p.m. PST September 30, 2009. Winners assume all liability for use of the gift. Only one (1) entry per person. Only one (1) gift per household for the Giveaway.

This giveaway is only open to permanent legal residents of the following states: Arizona, California, Colorado, Connecticut, District of Columbia, Delaware, Florida, Georgia, Iowa, Idaho, Illinois, Kansas, Louisiana, Maine, Michigan, Minnesota, Missouri, Montana, North Carolina, North Dakota, Nebraska, New Hampshire, New Mexico, Nevada, New York, Ohio, Oklahoma, Oregon, Rhode Island, South Carolina, South Dakota, Tennessee, Texas, Virginia, Vermont, Washington, Wisconsin, West Virginia, Wyoming, who are physically located therein, and who are 21 years of age or older as of the date of their entry. In order to be eligible, you must also reside in an city/state that can be legally shipped wine from the participating winery.

*Prize(s)
Three names will be selected as a winner from all valid entries and shall receive one (1) bottle of Frey Organic Wine compliments of Freyvinyard.com. Each of the three (3) items will be shipped individually during the month of October 2009. This gift is non-transferable, not redeemable for cash and not exchangeable for any other prize. If a winner is disqualified, Raw Epicurean reserves the right to determine an alternate winner or not to award that winner’s prize, in its sole discretion.

*Release
By participating, each participant and winner(s) waives any and all claims of liability against Raw Epicurean, the Company, its employees and agents, the Contest’s sponsors and their respective employees and agents, for any personal injury or loss which may occur from the conduct of, or participation in, the Giveaway, or from the use of any prize.

*Disclaimer
If for any reason the Giveaway is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Giveaway, the Sponsor reserves the right, in its sole discretion, to disqualify any individual who tampers with the Giveaway, and to cancel, terminate, modify or suspend the Giveaway. Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. Sponsor is not responsible for problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers computer equipment, software, failure of any email to be received by the Sponsor on account of technical problems or traffic congestion on the Internet or at any web site, or any combination thereof, including any injury or damage to participant’s or any other person’s computer related to or resulting from participation or downloading any materials in this Giveaway.

By participating in the Giveaway, each participant agrees to release and hold the Sponsor harmless from any and all losses, damages, rights, claims and actions of any kind in connection with or resulting from participation in the Giveaway and/or acceptance, possession, or use of any prize(s) including, without limitation, personal injuries, death, property damages and any claims by third parties or otherwise based on publicity rights, defamation, or invasion of privacy. Entrants acknowledge that Sponsor is not responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to any Prize.

*Compliance with Law
The conduct of the Giveaway is governed by the applicable laws of the United States of America, which take precedence over any rule to the contrary herein. Raw Epicurean shall follow the applicable laws for conducting giveaway/contests, including notice to the state attorney general or consumer affairs office, posting of a prize bond, furnishing lists of winners, running specific on-air disclaimers, providing specific written information about the Giveaway, etc. as required by local and state law.

Participating in this giveaway implies that you have read, understood, and agree to the terms and conditions of this giveaway.
